ohhey Terms of Service

Effective date: November 5, 2026

Last updated: November 5, 2026

Document version: 1.0.0

1. Who provides ohhey

Can't Get Back Time LLC, an Illinois limited liability company ("we," "us," or "our"), provides ohhey's mobile applications and public invitation pages (the "Service"). These Terms govern your use of the Service when you accept them through the account-creation flow or another agreement mechanism we provide. Our Privacy Policy, available through the app's legal documents, explains how we handle personal information. Accepting these Terms does not replace any separate consent required for optional permissions or particular uses of information. These are service terms; the Apple app license is addressed in section 9.

Simply opening a public invitation page does not itself constitute acceptance of these Terms. We do not treat an anonymous visitor as having accepted contractual limitations solely because they viewed that page. Applicable law and our Privacy Policy still govern our handling of visitor information.

Please read these Terms before accepting them. If you do not agree, do not create an account or use the Service. These Terms do not remove any rights that applicable law does not allow you to waive.

2. Eligibility and your account

You must be at least 13 years old to create an account. If you have not reached the age of legal adulthood where you live, you must have your parent or legal guardian's permission to use the Service and review these Terms with them. Where applicable law requires a parent or guardian to enter into the agreement for you, you may use the Service only after they have done so. These Terms do not make a parent or guardian a party merely because a minor states that permission was given. Do not provide a false birthday, impersonate someone, or create an account using a phone number you are not authorized to use.

Version 1 supports U.S. phone numbers. This phone-number limitation is not a verification of residence or a representation that the Service satisfies every jurisdiction's requirements. You may use the Service only where you meet applicable age and consent requirements and your use is lawful. Access to your phone number may be needed to verify account ownership. Keep your account information accurate and protect your device and verification codes. Do not share verification codes with someone who asks for them. Contact support if you believe someone has accessed your account without permission. We may require reasonable verification before acting on an account request; contacting support does not guarantee recovery of a lost account.

You are responsible for your own activity and content, subject to applicable law. Your carrier or internet provider may charge for verification texts, mobile data, or connectivity.

3. Invitations, privacy and sharing

ohhey helps people send invitations and respond to plans. An invitation, response, notification, or response total does not guarantee that an event will happen or that anyone will attend. Use your own judgment when deciding whom to meet and what information to share.

Your account privacy and each invitation's privacy are separate choices. A private account can send a public invitation. A public invitation can be viewed by anyone who has its valid link, including someone who is not signed in. The public web page shows limited creator information, invitation text, sent time and response totals; it does not show the complete guest list or accept web responses.

Follower-only and super-private invitations require authorized account access. Sharing a link does not transfer the sharer's access to the recipient. People who can see an invitation may still copy information or take screenshots outside ohhey. Do not include information you are not comfortable sharing with the audience you select, or personal information about someone else without appropriate permission.

4. Acceptable use

Use ohhey lawfully and respect other people. You must not:

Report suspected abuse through the relevant account or invitation safety controls, or contact report@ohhey.app. Do not submit reports you know are false or use reporting to harass another person.

5. Your content and our permission to operate the Service

You retain ownership of the content you provide. You must have the rights and permissions needed to provide that content and allow its use through the features you choose.

You grant us a nonexclusive, limited permission to store, process, reproduce and display your content only as reasonably needed to provide the Service, deliver it to its permitted audience, maintain security, handle reports and comply with applicable law. We may use service providers for those purposes. This permission does not transfer ownership of your content to us or give us permission to use it in advertising without a separate authorization.

When content is deleted or your account closes, this permission ends for ordinary display and delivery through the Service. Any remaining permission is limited to restricted processing during the retention and deletion periods described in section 8 and our Privacy Policy, secure backup handling under the disclosed provider schedules, and preservation specifically required by law. It does not authorize renewed ordinary display, advertising use or indefinite retention. Another person's independently supplied content is subject to their own rights and permissions; it does not extend our permission to use your deleted content. Deletion of your account is addressed below. Copies that people have made outside the Service are outside our control.

6. Safety, reports and restrictions

The Service provides blocking and reporting tools. A report may include information needed to investigate the reported account or invitation. We may review reports, remove or restrict content, or suspend, restrict or terminate accounts when reasonably necessary to address violations, security risks, misuse or legal obligations. We do not promise to review every interaction or respond to ordinary reports within a particular time. This does not limit any response, removal, preservation or reporting deadline required by applicable law.

Where reasonably practicable and lawful, we will explain a restriction and how to challenge a mistake. We may act without advance notice where needed to protect people or the Service, preserve evidence or comply with law. You may ask us to review a restriction or termination by emailing support@ohhey.app; review does not guarantee reinstatement. Ending access does not itself mean all records have been erased. We handle retained information under our Privacy Policy, applicable deletion rights and specific legal obligations.

For a request to remove an intimate image shared without consent, including a qualifying synthetic or altered image, email report@ohhey.app. No ohhey account is required. Identify the image and where it appears, provide contact information and a physical or electronic signature, and state that you have a good-faith belief it was published without the depicted person's consent; an authorized representative may submit the request. A profile username, invitation link or other information sufficient to locate the image can help. Do not email another copy of the intimate image or unrelated identity documents. Where the TAKE IT DOWN Act applies, we will remove covered imagery as soon as possible, no later than 48 hours after receiving a valid request, and make reasonable efforts within that same period to identify and remove known identical copies. A legally required removal is not postponed by the ordinary account-retention period or copyright counter-notice process.

Blocking is applied according to the Service's access rules. For attendance safety, a person who blocks another guest may still see that guest's limited identity and response on a third person's invitation. Blocking does not authorize access to that guest's photo or profile. Our Privacy Policy explains this distinction.

ohhey is not an emergency service. For an urgent threat or immediate danger, contact appropriate local emergency services rather than relying on an in-app report or email.

7. Contacts, notifications and other permissions

Contacts discovery is optional. It is performed when you explicitly choose to find people or refresh, using the contacts your device permits. You can use other core features without granting Contacts access. Device permissions can be changed through the operating system, subject to any parental or device-management restrictions.

Push notifications are optional and depend on operating-system permission, account settings and the notification rules explained in the app. Changing a notification preference does not change who can view an invitation. Verification texts used for sign-in are separate from optional invitation push notifications.

8. Signing out and requesting account deletion

Signing out ends your session on that device. It does not request deletion of your account. You can request account deletion from edit profile in the app. We may require a recent ownership verification before accepting the request.

Once the request is accepted, your account closes and is no longer available to other users through ordinary Service features. In version 1, a confirmed deletion request is final: it cannot be cancelled and the account cannot be restored during retention.

Our ordinary retention period is 30 days from acceptance of the deletion request. Account records under our control are held with restricted access during that period. At its end, records become due for automatic erasure through our daily deletion process. The scheduled date is the retention deadline, not a guarantee that every deletion operation finishes at that instant. Processing time and retried failures may delay completion; access remains closed while deletion is completed. We must address failures and complete erasure without undue delay, subject to any earlier deadline required by law. A retry of the same request does not start a new 30-day period. The app will show the accepted request and scheduled deletion date rather than claiming that all records have already been erased.

Our Privacy Policy explains the records covered, third-party processing, and provider deletion timelines. Some service-provider systems and backups have separate deletion schedules. We do not promise that every copy held by every provider disappears within 30 days. Where a specific law or valid legal preservation requirement requires a different result, we must follow that requirement and limit preservation to the records and duration required. We do not use this clause as a general permission to retain ordinary account records indefinitely.

Account deletion does not require deleting another person's independently supplied content. We remain responsible for removing your personal account information from our own systems and shared records as required by our deletion policy and applicable law. We cannot erase copies other people have independently saved outside ohhey.

9. Service ownership

The Service, its software, branding and other materials we provide are owned by us or our licensors, apart from user content and separately licensed materials. We permit you to use the Service through its authorized features while you comply with these Terms and applicable law. This does not grant ownership of the Service or permission to misuse our name, branding or another person's work.

For an app obtained through Apple's App Store, Apple's Standard End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) governs the app license. These Terms supplement that agreement for the operation of ohhey's Service; they are not a replacement custom EULA. Mandatory App Store usage rules and the Standard EULA control any conflict concerning the app license. These Terms do not expand our collection or use of information beyond our Privacy Policy and applicable law. Apple is not the provider of ohhey's invitation service.

Third-party software may be subject to its own licenses. Required acknowledgements and license texts are available through the app's acknowledgements destination. Those notices remain governed by their actual license terms.

10. Availability and changes

We may maintain, update or change the Service, and features may be unavailable temporarily. We do not guarantee uninterrupted availability, delivery of every notification, a particular response time, or compatibility with every device or browser. We may discontinue all or part of the Service for legitimate business, security or legal reasons. Where reasonably practicable, we will give advance notice of permanent discontinuation so you can request your information or deletion. Where required by law, we will provide notice or other remedies for changes that affect your rights. Discontinuation does not remove our data-handling obligations or accrued liabilities.

11. Warranties and responsibility

To the extent permitted by applicable law, the Service is provided on an "as available" and "as is" basis. We disclaim implied warranties of merchantability, fitness for a particular purpose and noninfringement to the extent they may lawfully be disclaimed. We do not guarantee uninterrupted or error-free operation. You remain responsible for your decisions to share information, respond to invitations and meet other people. We do not verify every user's identity or guarantee another person's conduct or an event's safety.

Subject to the exceptions below and to the extent permitted by applicable law, we are not liable for indirect, incidental, special or consequential damages, or lost profits, arising out of the Service or these Terms. Subject to those same exceptions, our total aggregate liability to you for claims arising out of the Service or these Terms will not exceed the greater of US $100 or the amount you paid us for the Service during the 12 months before the event giving rise to the claim. These limitations apply regardless of the legal theory of the claim, to the extent legally permitted.

The exclusions and cap above do not apply to our fraud, intentional wrongdoing or gross negligence; death or personal injury caused by our negligence; or any liability, statutory damages, warranty or remedy that applicable law does not allow us to exclude or limit. They do not restrict your right to seek an injunction or exercise nonwaivable privacy or consumer rights. Where a limitation is prohibited, the applicable legal protection controls.

12. Law and disputes

Subject to rights and protections that applicable law makes mandatory, Illinois law governs these Terms. A dispute may be brought in a court with lawful jurisdiction. These Terms do not require private arbitration or waive participation in a class action. You may contact support@ohhey.app to try to resolve a concern, but contacting us is not a prerequisite to exercising a right that the law gives you.

13. Updates to these Terms

We will publish revisions when necessary and identify when they take effect. We will provide notice of material changes and obtain agreement where required by applicable law. Changes will not be used to eliminate rights retroactively or authorize an undisclosed new use of existing personal information.

14. Copyright complaints

Send copyright complaints to report@ohhey.app with the subject "copyright notice." Identify the protected work and the material to remove, with enough location information for us to find it. Include your contact details and signature; a good-faith statement that the disputed use lacks authorization from the rights holder, its agent or the law; and confirmation of accuracy and, under penalty of perjury, your authority to act for the owner.

We will handle valid notices promptly and notify the affected user when appropriate. A user disputing a copyright removal may send a signed counter-notice identifying the material and its former location, explaining under penalty of perjury a good-faith belief in mistake or misidentification, and providing their name, address and telephone number. It must consent to the jurisdiction of the federal district court for their address, or, if outside the United States, a district where we may be found, and accept service from the complainant or its agent. We may forward the counter-notice, including its contact information, to the complainant. Where the DMCA restoration process applies, we will promptly send the complainant the counter-notice and explain the restoration process. Restoration follows 10–14 business days after receipt of a compliant counter-notice unless we receive notice of a qualifying court action. Separate lawful safety or Terms restrictions may still prevent restoration.

Our policy is to terminate repeat infringers' accounts in appropriate circumstances. Knowingly material misrepresentations in copyright notices or counter-notices may create liability under applicable law. Copyright procedures do not delay other legally required removals.

15. General provisions

If a provision is unenforceable, the rest of these Terms remains effective to the extent permitted by law. A delay in enforcing a provision does not waive our right to enforce it later.

You may not transfer your account or your rights under these Terms without our consent. We may transfer these Terms in connection with a merger, reorganization or sale of the business or Service, provided the successor assumes our obligations and the transfer does not reduce your mandatory rights. Any transfer of personal information remains subject to our Privacy Policy and applicable law, including required notice or consent.

These Terms, together with any additional terms you expressly accept for a particular feature and the app license described in section 9, form the agreement concerning your use of the Service. This does not exclude liability for misleading statements or remove rights and promises that applicable law protects. Provisions concerning accrued claims, ownership, restricted retention permissions, liability and disputes continue after account closure only to the extent needed for their stated purposes; they do not extend retention or permit renewed use of deleted content.
